Probation violator gets prison term for burglary

AUBURN - A young man serving two separate terms of probation was sentenced Thursday to state prison for burglarizing an Aurelius residence.
Theodore Verdugo, 20, of 101 Franklin St., Auburn, was sentenced in Cayuga County Court to one to seven years in state prison for the felony crime of third-degree burglary.

Verdugo entered the home and stole jewelry and a camcorder, which he pawned for $124.

He previously was sentenced in March 2005 in county court to five years probation and given youthful offender treatment.

Verdugo was arrested by state police in a separate theft case and told investigators that he stole $1,500 left in the glove compartment of a car parked in the Southfield Apartments' parking lot on Quill Avenue in December 2004.

He also was serving a term of probation ordered by a local court. Verdugo “failed to obey every term of probation,” Chief Assistant District Attorney Jon Budelmann said.

Verdugo said he was set to take his general equivalency diploma exam through the Cayuga County Jail and was getting information about college from a jail teacher.

Ultimately, his lengthy history, including time as a Person In Need of Supervision (PINS), was “not a good sign,” Judge Peter Corning said.

Also in court:

€ Corning reserved decision on a motion for Carl Crandall, 60, of 17 Abrio Drive, Moravia, to undergo a psychiatric exam.

Crandall is accused of threatening a bus driver with a hunting knife as the driver turned a bus around in Crandall's driveway Jan. 10. Crandall's assigned counsel, Sam Tamburo, said his client should be examined to explore a defense of not guilty because of a disease or defect. A surgeon found Crandall displayed cognitive defects after being struck in the head with a hammer, Tamburo said.

Corning expressed skepticism about ordering for county funds to pay for the $2,000 examination without more evidence.

€ Shawn Lynn, 20, of Union Springs, pleaded guilty to the felony crime of first-degree sexual abuse.

Lynn admitted molesting a 4-year-old girl last summer. His sentence is scheduled for Aug. 24.

€ David Westmiller, 29, with a last known address of 25 Hoffman St., Auburn, was released on his own recognizance by Corning and ordered to return for a court appearance next Thursday.

Westmiller had been held for a month in the Cayuga County Jail on a Florida fugitive warrant accusing him of failing to appear for court appearances related to the charge of nonpayment for rental property.
