SYRACUSE - A 20-year-old man accused of driving his motorcycle at more than a 100 mph and causing the death of a state trooper was sentenced Wednesday to 1 1/3 to four years in state prison for violating probation.
“We knew that would happen. The violation of probation is a much different standard of proof. It doesn't comes as a big surprise. That is what we expected the judge would sentence him to,” said defense attorney James Meggesto.
James Carncross, of Jamesville, was on probation for a previous grand larceny conviction and barred from owning or riding a motorcycle.
Carncross admitted to operating a motorcycle on April 23. But he has denied any involvement in the death of Trooper Craig Todeschini.
Todeschini, 25, of Geddes, was killed April 23 when his patrol vehicle crashed into a tree in the hamlet of Pompey Hill while chasing a speeding motorcyclist.
Carncross was charged with aggravated second-degree manslaughter and aggravated criminally negligent homicide in Todeschini's death. His case is awaiting grand jury action.
