Tape causes thief to plea

by The Citizen staff report

AUBURN - A Syracuse man was surprised he had a plea bargain offer six days after his arrest on a felony of fourth-degree grand larceny.
Auburn City Court Judge Michael McKeon told convicted felon Andre E. Chance, 38, of 208 Columbus St.-Apt. 2, Syracuse, that the court system moves a lot faster in Cayuga County than Onondaga County.

Chance was arrested in a Grant Avenue parking lot Thursday night on the charge he wheeled a Wal-Mart suitcase packed with 66 assorted DVDs out of the store.

McKeon indicated Wal-Mart has a security videotape of Chance stealing the suitcase. Hearing that, Chance opted Wednesday to take a plea bargain offer to plead guilty to the misdemeanor charge of petit larceny.

As part of the plea bargain offer, Chance was sentenced to one year in Cayuga County Jail, of which he will serve two-thirds if he gets credit for good behavior.

If Chance had decided against the plea bargain offer, his felony charge was ready for presentation to a Cayuga County grand jury Wednesday. He would have automatically faced state prison with a second felony conviction.

All $2,600 of the merchandise Chance stole was recovered.

" MY MY MY...his case would have gone in front of grand jury that quick. Wow. I know for a fact this county (cayuga) does not work that fast. "
